YOUR CONTINUED USE OF THIS SITE AND THE SERVICES FOLLOWING THE POSTING OF ANY CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES OR MODIFICATIONS. 1) Eligibility

6) Site Content
You understand that all postings, messages, text, files, images, photos, or other materials ("Content") posted on, transmitted through, or linked from inourneighborhood.com, are the sole responsibility of the person from whom such Content originated. Fraudulent conduct may be reported to law enforcement, and the management of inourneighborhood.com will cooperate to ensure that violators are prosecuted to the fullest extent of the law.
9) Notification of Claims of Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify inourneighborhood.com for notice of claims of copyright or other intellectual property infringement ("Agent"), at admin@inourneighborhood.com or: Copyright Agent inourneighborhood.com,inc. 10) Breach of Agreement Right to Investigate

11) Compliance with Federal Fair Housing Act
All real estate advertising is subject to the Federal Fair Housing Act of 1968, as amended. All housing advertised is available on an equal opportunity basis and does not discriminate on the basis of race, color, religion, national origin, gender, familial status, or handicap. When posting an advertisement for housing, you must comply with section 3604(c) of the Act. This statute prohibits stating, in any notice or ad for the sale or rental of a dwelling, a discriminatory preference based on race, color, religion, national origin, gender, familial status, or handicap. We will not knowingly accept any advertisement for real estate which is in violation of this law. 12) Release of Liability
Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree that inourneighborhood.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, INOURNEIGHBORHOOD.COM, INC. DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF INOURNEIGHBORHOOD.COM AND THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, INOURNEIGHBORHOOD.COM, INC. DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON INOURNEIGHBORHOOD.COM OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON INOURNEIGHBORHOOD.COM. TO THE FULLEST EXTENT PERMITTED BY LAW, INOURNEIGHBORHOOD.COM, INC. DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH INOURNEIGHBORHOOD.COM OR THE SERVICE. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.
14) Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL INOURNEIGHBORHOOD.COM, INC. BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF INOURNEIGHBORHOOD.COM, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF INOURNEIGHBORHOOD.COM OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF INOURNEIGHBORHOOD.COM OR THE SERVICE, FROM INABILITY TO USE INOURNEIGHBORHOOD.COM OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF INOURNEIGHBORHOOD.COM OR THE SERVICE. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH INOURNEIGHBORHOOD.COM OR THE SERVICE OR ANY LINKS ON INOURNEIGHBORHOOD.COM, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH INOURNEIGHBORHOOD.COM OR THE SERVICE OR ANY LINKS ON INOURNEIGHBORHOOD.COM. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdiction, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.
15) Indemnification
You agree to indemnify and hold inourneighborhood.com; including its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through the Service, your use of the Service, your violation of the Terms, your breach of any of the representations and warranties herein, or your violation of any rights of another.
16) Applicable Law
The laws of the State of Virginia govern these Terms, without giving effect to any principles of conflicts of laws.
17) Proprietary Rights

Content displayed on or through the Service is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws. 18) Arbitration

ANY SUCH CONTROVERSY OR CLAIM SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND SHALL NOT BE CONSOLIDATED IN ANY ARBITRATION WITH ANY CLAIM OR CONTROVERSY OF ANY OTHER PARTY. THE ARBITRATION SHALL BE CONDUCTED IN ABINGDON, VIRGINIA AND JUDGMENT ON THE ARBITRATION AWARD MAY BE ENTERED INTO ANY COURT HAVING JURISDICTION THEREOF. EITHER YOU OR MANAGEMENT MAY SEEK ANY INTERIM OR PRELIMINARY RELIEF FROM A COURT OF COMPETENT JURISDICTION IN ABINGDON, VIRGINIA, IF NECESSARY TO PROTECT THE RIGHTS OR PROPERTY OF YOU OR MANAGEMENT PENDING THE COMPLETION OF ARBITRATION AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.
19) License
inourneighborhood.com, inc. grants a limited license to each participant to make personal use only of inourneighborhood.com and the Services in accordance with these Terms. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of inourneighborhood.com and the Services (other than the buying and selling of items in accordance with the Terms), making any derivative of inourneighborhood.com or the Services, the collection and use of participant e-mail addresses or other participant information, ratings or listings, or any data extraction or data mining whatsoever.
20) Termination
You agree that inourneighborhood.com, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP
address, or otherwise terminate your access to or use of the Service (or any
part thereof), immediately and without notice, and remove and discard any
Content within the Service, for any reason, including, without limitation,
if inourneighborhood.com believes that you have acted inconsistently with the Terms. Further, you agree that inourneighborhood.com shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use inourneighborhood.com after said termination.
21) No Agency
inourneighborhood.com is not the agent, fiduciary, trustee or other representative of you. Nothing expressed or mentioned in or implied from the Terms is intended or shall be construed to give to any person other than the parties hereto any legal or equitable right, remedy or claim under or in respect to the Terms. The Terms and all of the representations, warranties, covenants, conditions and provisions hereof are intended to be and are for the sole and exclusive benefit of inourneighborhood.com and you.
22) Severability
If any provision of the Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
23) No Waiver
inourneighborhood.com’s failure to enforce the strict performance of any provision of the Terms will not constitute a waiver of inourneighborhood.com’s right to subsequently enforce such provision or any other provisions of the Terms.
24) No Spam Policy
You understand and agree that sending unsolicited email advertisements to inourneighborhood.com email addresses or through inourneighborhood.com computer systems are expressly prohibited by the Terms. Any unauthorized use of inourneighborhood.com computer systems is a violation of the Terms and certain federal and state laws. Such violations may subject the sender and his or her agents to civil and criminal penalties.
25) Entire Agreement
The Terms constitute the entire agreement between you and inourneighborhood.com and govern your use of the Service, superseding any prior agreements between you and inourneighborhood.com. The Terms and the relationship between you and inourneighborhood.com shall be governed by the laws of the State of Virginia without regard to its conflict of law provisions. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
